SideButton Terms of Service

1. Acceptance of Terms

By using SideButton ("the Software"), you agree to these Terms of Service. The Software is provided under the Apache-2.0 License, which governs your use of the source code. These additional terms apply to your use of the hosted website and any associated services.

2. Description of Service

SideButton is an open-source, local-first workflow automation platform. The Software:

  • Runs entirely on your local machine
  • Automates browser actions, shell commands, and AI interactions
  • Does not require an account for core functionality
  • Does not transmit your data to external servers (except when you explicitly configure third-party integrations)

3. User Responsibilities

You agree to:

  • Use the Software in compliance with all applicable laws and regulations
  • Respect the Terms of Service of any websites you automate
  • Not use the Software for malicious purposes, including unauthorized access, data scraping in violation of terms, or harassment
  • Take responsibility for any workflows you create and execute

4. Intellectual Property

SideButton is released under the Apache-2.0 License. You are free to:

  • Use the Software for any purpose
  • Modify and distribute the Software
  • Include the Software in commercial products

The Apache-2.0 License requires that you include the original copyright notice and license in any copy of the Software or substantial portion of it.

5. Third-Party Services

The Software may integrate with third-party services (AI providers, websites, APIs). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

6. Marketplace Content

The SideButton skills marketplace allows publishers to share workflow automations with the community. The following terms apply to marketplace content:

Publisher Responsibilities

Publishers who submit workflows to the marketplace represent and warrant that:

  • They own or have the necessary rights to the content they submit
  • The content does not infringe any third-party intellectual property rights
  • The content complies with our Content Policy
  • They will respond to reasonable inquiries about their content

License Grant

By publishing a workflow to the marketplace, you grant SideButton a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute your content through the marketplace and related services.

Content Removal

SideButton reserves the right to remove any marketplace content that:

  • Violates our Content Policy
  • Infringes intellectual property rights
  • Is subject to a valid legal complaint
  • May harm the platform, its users, or third parties

No Endorsement

The presence of a workflow in the marketplace does not constitute endorsement by SideButton. Users install and execute workflows at their own risk. We recommend reviewing workflow descriptions and publisher information before installation.

7. Copyright and DMCA

SideButton respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). We will respond promptly to valid notices of copyright infringement.

Filing a DMCA Notice

If you believe content on our marketplace infringes your copyright, please see our DMCA Policy for instructions on filing a takedown notice.

Counter-Notices

If you believe your content was wrongfully removed, you may file a counter-notice as described in our DMCA Policy.

Repeat Infringers

We will terminate the accounts of users who are repeat copyright infringers. A repeat infringer is a user who has been notified of infringing activity more than twice or has had content removed more than twice.

8. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Software.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable laws of the Member State where the service provider is established, without regard to conflict of law principles.

For consumers residing in the European Union, any disputes arising from these Terms may be submitted to the competent courts of your place of residence. Nothing in these Terms affects your statutory rights as a consumer under applicable EU consumer protection laws.

11. Online Dispute Resolution

In accordance with Regulation (EU) No 524/2013, the European Commission operates an online dispute resolution (ODR) platform for consumers who wish to resolve contractual disputes arising from online purchases: https://ec.europa.eu/consumers/odr/.

Pursuant to § 36 of the German Consumer Dispute Resolution Act (VSBG), we declare that we neither participate in nor are obligated to participate in dispute resolution proceedings before a consumer arbitration board.

We may update these Terms from time to time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Software after changes constitutes acceptance of the new Terms.
